Terms of Service

1. Acceptance of Terms

By accessing or using the Elite Dynasty website (elitedynasty.in), participating in our tournaments, joining our Discord server, engaging with our content on any social media platform operated by Elite Dynasty, or otherwise interacting with our community features, you irrevocably agree to be bound by these Terms of Service ("Terms"). If you disagree with any provision of these Terms, you must immediately discontinue all use of the Service.

2. Eligibility

To participate in Elite Dynasty events, you must:

• Be at least 13 years of age (or the minimum age required to play the respective game in your jurisdiction).
• Not be banned from any official publisher platforms (e.g., Garena, Krafton, Riot Games, Activision).
• Register with accurate and verifiable information.
• Comply with local, state, national, and international laws and regulations applicable to your use of the Service.

3. Code of Conduct

We are a competitive gaming community built on respect and fair play. Users agree NOT to:

• Use hacks, cheats, macros, exploits, or unauthorized third-party software in any game, tournament, or scrim organized by Elite Dynasty.
• Engage in toxic behavior, harassment, hate speech, discrimination, doxxing, swatting, or any form of cyberbullying.
• Match-fix, collude, share accounts, or engage in any form of competitive manipulation during official or unofficial tournaments.
• Distribute, reproduce, or commercially exploit any Elite Dynasty content, media, or proprietary materials without express written authorization.
• Impersonate Elite Dynasty staff, moderators, or team members in any capacity.

Violation of the Code of Conduct will result in immediate disqualification, forfeiture of all prizes (if applicable), and strong potential for a permanent ban from the platform, with no right of appeal.

4. Intellectual Property

All content, features, functionality, creative works, visual designs, branding materials, logos, trademarks, service marks, trade dress, graphics, animations, audio, video, text, and software associated with the Elite Dynasty website, Discord server, social media channels, and any other digital properties ("Elite Dynasty IP") are and shall remain the exclusive property of Elite Dynasty and its licensors, protected under applicable intellectual property laws including but not limited to copyright, trademark, and trade secret law.

Without limiting the foregoing:

• The "Elite Dynasty" name, logo, taglines (including but not limited to "#1 Gaming Community"), visual identity, brand color palette, and all associated branding elements are proprietary assets of Elite Dynasty.
• Tournament formats, rule sets, scoring systems, and competitive structures designed by Elite Dynasty constitute proprietary trade secrets and may not be reproduced, reverse-engineered, or adapted without prior written consent.
• Any user-generated content submitted to or through Elite Dynasty platforms (including but not limited to gameplay clips, highlights, commentary, fan art, and social media posts) grants Elite Dynasty a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content across all media channels for promotional, commercial, or community purposes.
• Third-party intellectual property, including but not limited to Garena Free Fire™, BGMI™, and any future game titles featured on the platform, remain the exclusive property of their respective owners (Garena, Krafton, Riot Games, Activision, Electronic Arts, Ubisoft, Rockstar Games, Sony Interactive Entertainment, Microsoft, Roblox Corporation, and others). Elite Dynasty claims no ownership of third-party marks and uses them solely for informational and community-building purposes.
• Any unauthorized reproduction, distribution, modification, public display, or commercial exploitation of Elite Dynasty IP may result in civil and criminal penalties under applicable law, in addition to immediate termination of your access to all Elite Dynasty services.

5. Tournaments & Prize Distribution

Tournament prizes, reward pools, and giveaways are subject to the following conditions:

• All prizes are awarded at the sole discretion of Elite Dynasty and are subject to verification of eligibility, identity, and compliance with tournament rules.
• Prize distribution timelines are estimates and typically processed within 30 days following official result verification, utilizing secure payment gateways or escrow services.
• KYC/AML Compliance: All prize recipients must complete a mandatory Know Your Customer (KYC) and Anti-Money Laundering (AML) verification process, which includes providing a valid PAN card and government-issued ID, before any funds are released.
• Taxation (India): As required by Indian law (Section 115BBJ of the Income Tax Act), a flat 30% Tax Deducted at Source (TDS) will be applied to all net winnings. Elite Dynasty is legally obligated to deduct this tax prior to prize disbursement.
• Elite Dynasty reserves the right to withhold, reduce, or forfeit prizes in cases of suspected fraud, rule violations, unsportsmanlike conduct, or failure to complete mandatory KYC verification.
• Except for the mandatory TDS deduction, any other tax liabilities arising from prize winnings are the sole responsibility of the recipient.

6. Affiliate Program Earnings

Participants in the Elite Dynasty Affiliate Program are subject to the following terms regarding referrals and payouts:

• Affiliates earn commissions based on legitimate, verified referrals. Self-referrals or using fraudulent accounts will result in immediate termination from the program.
• Commissions are calculated as a percentage of entry fees or specific qualifying purchases made by the referred user, as outlined in the active Affiliate Tier structure.
• Payouts are processed within 30 days following the end of the calendar month in which the earnings accrued, provided the affiliate has met the minimum payout threshold.
• Elite Dynasty reserves the right to audit referrals, adjust commission rates, or withhold payments in instances of suspected abuse or breach of these Terms.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ELITE DYNASTY, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, REPUTATION, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India. In the event of any dispute, both parties agree to first attempt resolution through good-faith negotiation for a period of thirty (30) days before pursuing formal legal proceedings.

9. Modifications to Terms

Elite Dynasty reserves the right to modify or replace these Terms at any time at its sole discretion. Material changes will be communicated via our website, Discord server, or email notification. Continued use of the Service after any such changes shall constitute your acceptance of the new Terms. Users are encouraged to review these Terms periodically.
